“ADA” is an acronym for the Americans with Disabilities Act, which requires businesses and website owners to make accommodations for people with disabilities in all their web content.
That is, all web content should be accessible to the blind, deaf, and those who must navigate by voice, screen readers or other assistive technologies.
This law has been in force for over a decade but has been fairly dormant until 2018 when a supreme court judgment was passed on a website owner for non-compliance. This caused a sudden surge in businesses and website owners being sued for noncompliance with ADA.
And since then, over 1,500 legal cases related to non-accessibility compliance issues were filed in New York alone in 2018.
More than 10,000 websites were sued nationwide in 2019 for their website not being ADA compliant. This number is expected to hit 100k by 2021.
Most businesses/website owners sued for non-compliance pay between $20k-$200k as out of court settlement. A recent settlement was $6m.
Unfortunately, unlike GDPR, the ADA law requires no notice before a lawsuit is filed against a company for non-compliance. But don’t despair because the fix is easy and inexpensive!
